Terms of Service

1. Acceptance of Terms

By downloading, installing, or using the SuperPT mobile application and web platform ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use the Service. These Terms constitute a legally binding agreement between you and SuperPT ("we", "us", or "our").

2. Description of Service

SuperPT is a client management platform designed for personal trainers. The Service enables personal trainers to manage their clients, create and assign workout programs, track client progress, communicate with clients, and manage their business operations through a mobile application and web platform.

3. Eligibility

You must be at least 16 years of age to use the Service. By using the Service, you represent and warrant that you meet this age requirement. If you are using the Service on behalf of a business or organization, you represent that you have the authority to bind that entity to these Terms.

4. Account Registration

To access certain features of the Service, you must create an account. When registering, you agree to:

  • Provide accurate, current, and complete information
  • Maintain and update your account information as needed
  • Keep your login credentials secure and confidential
  • Accept responsibility for all activities that occur under your account
  • Notify us immediately of any unauthorized use of your account

5. User Responsibilities

When using the Service, you agree not to:

  • Violate any applicable laws, regulations, or third-party rights
  • Upload or share content that is unlawful, harmful, threatening, abusive, defamatory, or otherwise objectionable
  • Attempt to gain unauthorized access to the Service, other user accounts, or any related systems
  • Use the Service to transmit viruses, malware, or other harmful code
  • Interfere with or disrupt the integrity or performance of the Service
  • Use automated systems (bots, scrapers, etc.) to access the Service without our written permission
  • Impersonate any person or entity, or misrepresent your affiliation with any person or entity

6. Subscription & Payments

Certain features of the Service may require a paid subscription. By subscribing, you agree to the following:

  • Billing: Subscription fees are billed in advance on a recurring basis (monthly or annually) through the Apple App Store or Google Play Store
  • Auto-Renewal: Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current billing period
  • Price Changes: We reserve the right to adjust pricing. You will be notified of any price changes in advance
  • Refunds: Refunds are handled in accordance with the refund policies of the Apple App Store or Google Play Store

7. Intellectual Property

The Service and its original content, features, and functionality are owned by SuperPT and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

You retain ownership of any content you submit, post, or display through the Service. By submitting content, you grant SuperPT a non-exclusive, worldwide, royalty-free license to use, reproduce, and display such content solely for the purpose of operating and providing the Service.

8. Health & Fitness Disclaimer

SuperPT is a management and communication tool and does not provide medical advice, diagnoses, or treatment. Important considerations:

  • The Service is not a substitute for professional medical advice or consultation with a qualified healthcare provider
  • Always consult a physician before beginning any exercise program
  • Personal trainers using the Service are independent professionals and are solely responsible for the programs they create and the advice they provide
  • SuperPT does not verify the qualifications or certifications of personal trainers using the platform

9. Limitation of Liability

To the maximum extent permitted by applicable law:

  • The Service is provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied
  • SuperPT shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service
  • Our total liability for any claims arising from the Service shall not exceed the amount you paid to us in the twelve (12) months preceding the claim
  • SuperPT is not responsible for any injuries, health issues, or damages resulting from workouts or fitness programs created or managed through the Service

10. Termination

We may suspend or terminate your access to the Service at any time and for any reason, including but not limited to:

  • Violation of these Terms
  • Fraudulent or illegal activity
  • Non-payment of subscription fees
  • Extended period of inactivity

You may terminate your account at any time through the Settings section within the app or by contacting us at support@superpt.app. Upon termination, your right to use the Service will immediately cease.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Republic of Turkey, without regard to conflict of law principles. Any disputes arising from these Terms or the Service shall be subject to the exclusive jurisdiction of the courts of Istanbul, Turkey.

12. Changes to These Terms

We reserve the right to modify these Terms at any time. When significant changes are made, we will notify you via in-app notification or email. Your continued use of the Service after changes are posted constitutes acceptance of the revised Terms. We encourage you to review these Terms periodically.
